Think of trademarks as a company's signature - they're what sets them apart. But here's the catch: a trademark is only protected where it's officially registered. When it comes to the international stage, things can get tricky.
Can a company lose its trademark rights in another country? Absolutely. Take the example of McDonald's and their beloved "Big Mac" trademark.
McDonald's had the exclusive rights to "Big Mac" in the EU since 1998, specifically for food items. However, in 2017, Supermac’s, an Irish fast-food chain, stirred the pot. They alleged that McDonald's hadn't actually used the "Big Mac" trademark for the right products over the past five years - a big trademark no-no under EU IP laws.
What happened next? In 2019, the EU revoked McDonald's rights to the "Big Mac" trademark. But hold on, here’s a twist. After appealing the decision, McDonald's regained some of their trademark rights.
